DayLaborDepot is only an online platform for connecting Consumers and Service Providers (day laborers). Because DayLaborDepot is not involved in the actual contact between Consumers and Service Providers, or in the completion of the Service, in the event that you have a dispute with one or more Users, you release DayLaborDepot (and our officers, directors, agents, investors, subsidiaries, and employees) from any and all claims, demands, or damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
Furthermore, the User hereby indemnifies DayLaborDepot and holds it harmless against any and all liability, loss, damage, penalty, cost or claim of whatsoever nature suffered by the User or any third party in relation to any act or omission by the Users or the User’s members, employees, representatives, agents or assigns or any third party in relation to the Website and the use thereof by the User, and/or arising from the provisions of these Terms and Conditions. Customers and service providers (day laborers) are required to register in order to use the Website. You agree to provide your cell phone number for registration and for DayLaborDepot to contact you. Additional fees might occur from your cell phone carrier when using the text messaging service and you are responsible to pay these fees if they occur.
DayLaborDepot reserves the right to terminate the participation of any users without reason but expressly including any users that DayLaborDepot judges to be in viola0tion of the Terms and Conditions. Users in violation of DayLaborDepot's Terms and Conditions will have their service immediately deactivated. DayLaborDepot may deactivate Users’ access with no prior notification.
DayLaborDepot will refund any fee paid by our Customers to DayLaborDepot if Customers request at cancellation on our Website at least 24 hours before the service starting time, or day laborers cancel the service at any time. If day laborers cancel the service less than 24 hours before the service starting time, they will be rated “one star” on their review for this service. After three of these incidents, the day laborers will be banned from using this Website in the future.
DayLaborDepot doesn’t conduct background checks on our Customers or our Service Providers. Either party is advised to conduct its own checks if it is so desired.
These Terms and Conditions shall be governed by the local, State, and United States Federal laws.
